Why Properly Training Your Associates Is Crucial

One of the most crucial aspects of running a successful practice is to properly train your associates, especially if they’re handling complex cases. We know from experience that an associate who’s in over their head can create serious issues, even leading to a complaint. Many board complaints stem from therapists who take on cases they aren’t fully prepared for, and as supervisors, it’s our job to prevent that.

I always emphasize that an associate should only handle what they’re ready for, and this means monitoring their progress closely. Remember, if there isn’t a clear path of development in your practice, you’re setting them (and yourself) up for challenges. This is why training protocols and documented supervision contracts, while not legally required, are best practices that keep everyone on the same page.

Now, here’s where liability insurance for therapists really shines. While some agencies provide liability insurance, it’s often a good idea for associates to have their own policy as well. Kenda recommended this approach to safeguard both the practice and the individual.

Think of it as a peace-of-mind investment. Even if you’re well-insured by your employer, an additional personal policy adds a layer of protection that covers unexpected situations.

How to Find Solid Liability Insurance For Therapists

When evaluating liability insurance, ask detailed questions. For example, does the policy cover legal representation from the moment a complaint is filed? Or does it only reimburse you after the fact? Ensuring your policy supports your needs upfront is essential—this is where reading the fine print can save you major headaches down the line.

One “scary” reality of our field is that not all best practices are spelled out in the rules. For instance, Texas doesn’t require a supervision contract, but protecting your practice in this way is widely recognized as a best practice.

This document not only provides clarity but also serves as a useful record in case of disputes. You might think, “Well, if the board doesn’t require it, do I need it?” The answer is a resounding yes—if you’re ever facing a board review, having a contract on file can only work in your favor.

Additionally, holding onto supervisee notes for seven years (or five years past the age of majority) aligns with best practices for record retention. It's not specified in the rules that you have to do this, but it's an extremely good idea! These are small steps, but they add layers of accountability and protection.

Texas Complaint Notification Process

Another hot topic is the evolving complaint notification process in Texas. If you’re a Texas therapist, be aware that complaint notifications may now arrive via email.

Although this shift aims to increase efficiency, it’s essential to check your spam folder regularly and ensure any emails from the board don’t go unnoticed. A missed email could mean missing critical response deadlines, which could impact your standing with the board.
